使用者條款

本使用者條款(以下稱「本條款」)適用於所有位於及連結於 chessintaiwan.com 網域之網站(以下稱「ChessInTaiwan」、「我們」「我們的」)。

同意條款

不論個別的使用者其物理位置於何處,本條款適用於所有連結至 ChessInTaiwan 之會員或訪客(以下合稱「使用者」、「您」),透過持續使用 ChessInTaiwan 提供之服務,即表示您已知悉且同意本條款,若您不同意本條款之部分或全部內容,您應立即停止使用 ChessInTaiwan。

使用者未滿七歲,不得於 ChessInTaiwan 「建立帳號」(如涉及購買課程等事項,請參考購課合約之約定),須由其法定代理人建立帳號。如使用者已滿七歲未滿二十歲,則其申請註冊成為會員前,需得其法定代理人同意,始得註冊及使用 ChessInTaiwan 所提供的會員服務。使用者未滿二十歲,須保證其獲得法定代理人同意可使用 ChessInTaiwan 提供的服務。當該使用者申請註冊成為會員,並繼續使用 ChessInTaiwan 提供的服務時,則表示其法定代理人已經閱讀且知悉並同意本條款。

本條款更新

ChessInTaiwan 在法律准許的範圍內,有權隨時修改、調整本條款中的任何條款內容。一旦 ChessInTaiwan 對本條款內容進行修改或調整,ChessInTaiwan 將會以公告形式發佈通知。任何修改或調整將於公布之時起生效。如果使用者在修改公布後,繼續使用 ChessInTaiwan 所提供的服務,則表示同意遵守本條款之更動。因此,請使用者務必定期查閱本條款,以確保了解本條款的所有更動。如果使用者不同意 ChessInTaiwan 對本條款之更動,請離開 ChessInTaiwan 網站並立即停止使用 ChessInTaiwan 服務,同時,會員應刪除個人檔案並註銷會員資格。ChessInTaiwan 亦有權於下列違規情事發生時,刪除會員個人檔案並註銷會員資格。

會員帳號及密碼安全

無論使用者是訪客或會員,都可以瀏覽 ChessInTaiwan 上的內容,但只有註冊成為會員之使用者始得購買線上課程並享受 ChessInTaiwan 提供的各項服務。訪客可以很容易在 ChessInTaiwan 上建立帳號,只要輸入 Email 和密碼登入即可。

使用者不應使用任何與其個人真實資料無關之資訊建立其帳號名稱,包括但不限於使用模仿他人姓名或使用攻擊性的字眼、任何種族歧視的文字及任何會傷害、侵害他人權利之文字作為帳號名稱,如發生前開事項,ChessInTaiwan 有權終止該帳號的服務。在僅建立帳號但尚未購買課程前(購買產品後,即依照購課合約之約定),應注意如下事項:會員應妥善保管其帳號及密碼,不應將其帳號及密碼轉讓或出借給他人使用,如會員發現其帳號遭他人非法使用,應立即通知 ChessInTaiwan。因駭客行為或會員的保管疏忽導致帳號、密碼遭他人非法使用,ChessInTaiwan 不負擔任何責任。

您有義務妥善保管帳戶、密碼及其他相關身分驗證資訊,並為此帳號登入系統後所進行之一切活動、行為負責,包括但不限於衍生之相關費用。

您同意在使用 ChessInTaiwan 時遵循所有適用法律,且僅可基於合法目的使用本服務。以非經 ChessInTaiwan 同意或指示之方式使用本服務或接觸系統,均應被嚴格禁止,ChessInTaiwan 有權停止提供該使用者之服務。

隱私權政策

使用者提供的個人資料及 ChessInTaiwan 保存與使用者相關之若干其它資料將受到中華民國法律和 ChessInTaiwan 隱私權政策之規範。

使用規定和條約

任何經由 ChessInTaiwan 服務上傳、張貼、發送電子郵件或任何其它方式傳送的文字、文件、影片、照片(包括使用者的照片)、圖片、聲音、音樂作品、創作作品或任何其他內容(以下簡稱「內容」),無論為公開或是私下傳送,均由內容提供者承擔責任。ChessInTaiwan 針對任何會員上傳未經授權之內容,部負擔任何責任。

使用者均不得下載、重製、公開傳輸、轉售、公開播放、分享或使用 ChessInTaiwan 及 ChessInTaiwan 上之文章或內容。使用者違反前述規定,將負擔所有因此侵權行為而生之法律責任。

預購及課堂參與

ChessInTaiwan 是一個媒合平台。ChessInTaiwan 允許部份會員提出課程並尋求其他會員的預購(預購者)。提出課程的這些會員即課程老師,而預購者或是購買課程之會員即為學生。

第三方連結

ChessInTaiwan 可能含有連結至 ChessInTaiwan 以外之第三方網站,由於 ChessInTaiwan 無法控制這些網站及資源,因此使用者在使用各該第三方網站前,需自行瞭解各該第三方網站之使用者條款及隱私權政策。

智慧財產權

ChessInTaiwan 擁有 ChessInTaiwan 及於 ChessInTaiwan 上發表之所有內容(“網站內容”)之所有權利,所有權及一切因此所生之利益,包括所有著作權、專利、商業秘密,商標和其他智慧財產權。所有未被明確授權之權利將僅能由 ChessInTaiwan 行使。

網站內容的所有材料和組合,包括但不限於檔案、課程、各式圖片、報告、課程介紹、講師介紹和常見問答均以 ChessInTaiwan 為著作人。您對網站內容的所有材料和組合的使用均受本條款之約束。

ChessInTaiwan 的設計或排版受著作權,外觀設計,商標,公平法和其他法律的保護,不得進行部分或全部之重製或模仿。未經 ChessInTaiwan 明確授權,不得重製或轉發 ChessInTaiwan 的商標,設計、聲音或圖像。

內容和其他合法權益

ChessInTaiwan 並非所有上傳至 ChessInTaiwan 內容之所有者。然而當會員發表、上傳、提交內容至 ChessInTaiwan 的留言或對話板,該會員即同意授與 Gozens集團全球的、不可撤銷的、非獨家的、免費的授權可以重製、使用、發表、翻譯、公開展示、公開傳輸、公開傳播、改作前述內容至所有現在或未來的媒體平台。該會員同意前述使用將無須支付任何費用。

終止服務

使用者同意ChessInTaiwan 有權可基於其判斷或任何原因,隨時以各樣理由終止或暫停會員使用 ChessInTaiwan 之服務,包括但不限於該會員顯少使用服務、違反本條款等。而對已購課會員課程相關服務事項的終止,則另依購課合約之約定。

ChessInTaiwan 於終止服務後,不論是否已通知,均得刪除該會員之帳號及內容,並可避免該使用者於未來連結至 ChessInTaiwan 或使用 ChessInTaiwan 平台。

賠償

使用者擔保如 ChessInTaiwan 及其管理階層、董事、員工、代理人及承包商因 a) 該使用者所發布或遞交之內容 b) 使用 ChessInTaiwan c) 該使用者違反本條款及 d) 使用者侵犯第三人之任何權利,而產生之各樣主張、要求,從而受有損失、須負擔責任、損害賠償或支出(包括但不限於合理的律師費用),使用者同意賠償。

資料備份

使用者同意隨時為資料備份,以防資料遺失,ChessInTaiwan 不對任何內容遺失及使用者因此而受的相關損失承擔責任。

與廣告商進行之交易

使用者明白於 ChessInTaiwan上所投放之廣告內容、行銷文字及商品說明等各種銷售資訊,均由各該廣告商、產品與服務供應商所刊登,ChessInTaiwan 僅接受委託予以刊登,對內容並不做實質之審查或修改,請使用者自行謹慎斟酌判斷此等廣告之正確性與可信度。除有關法律法規有明文規定要求 ChessInTaiwan 承擔責任以外,使用者因前述廣告而產生之交易遭受的任何的損失或損害,ChessInTaiwan 均不予負責。

禁止商業行為

使用者同意於使用 ChessInTaiwan 時將不會:a) 修改、重製、對於任何功能、程式進行還原工程 (reverse engineering)、反向組譯(disassemble)或任何企圖取得原始碼或內容之行為;b) 於上架之課程內容,包含任何商業或置入性行銷之內容,ChessInTaiwan 有權自行認定並將違反規定之內容無條件下架或移除。

擔保與保證

ChessInTaiwan 不保證以下事項:a) 本服務將符合使用者的特定要求;b) 於 ChessInTaiwan 購買或取得之任何產品、服務、資訊或其它課程將符合使用者的期望。

一般性條款

本條款及使用者與 ChessInTaiwan 之關係,均以中華民國法律為準據法。使用者與 ChessInTaiwan 就本服務、本條款或其它有關事項發生的爭議,應以台灣台北地方法院為第一審管轄法院。倘本條款之部分規定因與中華民國法律抵觸而無效者,本條款其它規定仍應具有完整的效力及效果。本條款之標題僅供方便而設,不具任何法律或契約效果。

ChessInTaiwan Terms of Service

These Terms of Service (the “Terms of Service”) apply to the website located at chessintaiwan.com, (“ChessInTaiwan” “We,” “Our”), and all associated sites linked to www.chessintaiwan.com .

User Agreement

These Terms of Service apply to all visitors and members (“users”) entering ChessInTaiwan, regardless of the physical location of the individual accessing user. By using the service provided by ChessInTaiwan, you are expressly accepting these Terms of Service. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use ChessInTaiwan. Please also read Our Privacy Policy before you use any portion of ChessInTaiwan. If you have any questions, please feel free to contact customer service immediately. The rights and obligations of the Coaches are stated in the separate Coaches Agreement.

User who is under the age of seven, is prohibited to create an account on ChessInTaiwan. If the user has reached the age of seven and is under the age of twenty, the consent of a parent or guardian is required before creating an account and using the services provided by ChessInTaiwan. Users under the age of 20 must confirm to have obtained the consent of their parent or guardian. When the user completes the application and continues to use the services provided by ChessInTaiwan, it means that a parent or guardian has read, understood and agreed to the terms.

Terms Update

ChessInTaiwan reserves the right to modify any of the terms at any time, to the extent permitted by law. ChessInTaiwan will make an announcement of the update on ChessInTaiwan and any changes will take effect from the time of the announcement. By continuing to use the services provided by ChessInTaiwan, users agree to the modifications made to these Terms. Therefore, users are requested to review these Terms periodically to ensure awareness of all recent changes. If the user disagrees with ChessInTaiwan’s modifications to the Terms, please exit ChessInTaiwan and cease use of the services on ChessInTaiwan immediately. Meanwhile, users shall delete their profiles and terminate their accounts. ChessInTaiwan also has the right to delete the user’s profiles and terminate the account when below violations occur.

Accounts and Passwords Safety

All visitors have access to browse the content published on ChessInTaiwan, but only a member who creates an account is eligible to take online courses and enjoy most of the services provided by ChessInTaiwan. Visitors can easily create an account on ChessInTaiwan by using an email address or an existing Google or Facebook account to log in. When setting up and maintaining the account, members must provide and continue to provide accurate and complete information regarding the personal information required to create the account. All personal information provided are used as login credentials. Any incomplete or untrue information provided upon registration is considered a violation of the Terms of Service, and ChessInTaiwan has the right to terminate service to the user. ChessInTaiwan is not responsible for any issue raised due to incomplete and untrue registration information and the associated consequences.

Users are prohibited from creating usernames that is not using their true personal information, including but not limited to mimic any third-party’s name, harm or infringe the rights of any other person. ChessInTaiwan holds the right to terminate service to the user in such event. Members are responsible for maintaining the confidentiality and security of their account credentials. Please notify us immediately upon suspecting a security breach. ChessInTaiwan assumes no responsibility for the illegal use of accounts and passwords due to hacking or negligence of member.

Members are responsible for maintaining the security of account credentials and fully responsible for all the activities that occur under the account and any other actions taken in connection with the account.

Users shall only use the service of ChessInTaiwan as permitted by law. Interfere with ChessInTaiwan or try to access the service of ChessInTaiwan by using the method other than the interface and the instructions provided by ChessInTaiwan is strictly prohibited and ChessInTaiwan has the right to terminate the service to the Users.

Privacy Policy

All registration personal information kept by ChessInTaiwan is protected under the laws of Taiwan and our Privacy Policy.

Terms of Use

Access to the content of the course publication is only available on ChessInTaiwan by the single member who has purchased and enrolled in the course within the agreed time limit. Streaming or publicly displaying the contents is strictly prohibited. A violation of the above may result in termination of account service. Depending on the case, ChessInTaiwan has the right to file legal action and claim punitive damages of 1,500 times the original price of publication from the violator.

Any text, document, image, video, photos (including photos of users), audio, music, or artwork (“content”) uploaded or distributed via ChessInTaiwan’s Service, whether publicly or privately, are the responsibility of its provider. ChessInTaiwan assumes no responsibility for any unauthorized use of the uploaded content among members.

ChessInTaiwan cannot guarantee the legality, correctness, completeness or quality of the content delivered via our service. ChessInTaiwan shall not be held liable for the content uploaded by its members of which a third party may claim infringement, unpleasant, inappropriate or objectionable. However, ChessInTaiwan reserves the right to immediately cease the aforesaid distribution, delete any of the content and take appropriate actions, including but not limited to suspending the member from all or part of our service, or take legal action depending on the case. Users must abide by the laws and regulations of Taiwan and agree not to use the service for any illegal or improper activities.

Users may not download, reproduce, redistribute, sell, broadcast, share, or use any content of the course and ChessInTaiwan. Users who violate the previous section, he/she should be responsible for the damages caused.

Pre-order, Course Enrollment and Tournement Booking

ChessInTaiwan is a matchmaking platform. We allow members to publish course content (“publication”) and recruit other members to pre-order the publication. Members who publish publication are course instructors (“Coaches”) while members who pre-order or purchase the publication are students (“Students”). ChessInTaiwan uses ECPay of Green World FinTech Service Co., Ltd. to process payments. By using ChessInTaiwan’s service, members agree to the Terms and Conditions stated on ECPay website. ChessInTaiwan is not responsible for any disputes raised between Coaches, Students and other users.

ChessInTaiwan will not make guarantee for any individual or group, nor will it be liable for any of disputes, claims, losses, or damage of any kind that might arise out of or relate to the conduct of Coaches or Students.

As stated before, ChessInTaiwan is only a matchmaking platform., therefore, the Coaches is solely responsible for the course and the entirety of the publication. ChessInTaiwan reserves the right to cancel the course and refund the full amount of all purchases at any time. ChessInTaiwan assumes no responsibility for the effectiveness and quality of the Green World ECPay service. Any payment disputes with ECPay occurs, members should follow ECPay’s instruction to solve, ChessInTaiwan makes no guarantee that the payment is completed. The Coaches then is free to make a refund, for which ChessInTaiwan is not responsible. ChessInTaiwan reserves the right to cancel, modify and interfere with the publication at any time.

Third Party Links

ChessInTaiwan may contain links to third party websites that are external to ChessInTaiwan. ChessInTaiwan has no control over the links and resources of third-party websites, so the users shall learn about the terms, conditions and privacy statements of the third-party website before accessing to whatsoever for any loss or damage caused by the content, products or other materials accessed through third-party websites and resources. ChessInTaiwan does not endorse or make any representation, guarantee or assurance regarding any third-party website or resources.

Intellectual Property Rights

ChessInTaiwan retains all right, title, and interest in and to any and all of its intellectual property rights on ChessInTaiwan and the content (“Website Content”), including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights. Any rights not expressly granted herein are reserved.

All materials and components of the Website Content, including documents, course video, images, reports, course introductions, Coaches introductions and FAQs that are made available as part of the Website Content are the copyrighted work of ChessInTaiwan. Your use of these all materials and components of the Website Content is governed by these terms.

The design or layout of ChessInTaiwan are protected by copyright, trade dress, trademark, unfair competition, and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound, or image from ChessInTaiwan may be copied or retransmitted unless expressly permitted by Gozens Group.

Content and Other Legal Rights

ChessInTaiwan does not claim ownership of any content members uploaded or submitted to ChessInTaiwan. However, by posting, uploading or submitting the content, members are granting ChessInTaiwan a worldwide, irrevocable, non-exclusive, royalty-free license to copy, use, reproduce, adapt, publish, translate, transmit, publicly display, edit, reformat and distribute the aforesaid content in any existing or future media. No compensation will be paid with respect to the use of members’ submission, as provided herein.

Termination of Service

The user agrees that ChessInTaiwan has the right to terminate or suspend permission to use ChessInTaiwan platform and services at any time for any reason, including but not limited to lack of use, violation of Terms of Service. Upon any such termination Gozens Group may delete the user’s account and content, and prevent users from further access to service of ChessInTaiwan, with or without notice.

Indemnification

The user shall indemnify and hold harmless ChessInTaiwan and each of its officers, directors, employees, agents or contractors from and against any claims, demands, losses, liability, damages, or expenses(including reasonable attorney fees) arising from(a)the content the user posts or submits,(b)the use of the services(c)the user’s violation of these Terms, or(d)the user’s violation of any rights of a third party.

Modification to the service

ChessInTaiwan has the right to suspend or terminate our service (or any part of it) within the scope permitted by law, with or without notice. Users are advised to back up the materials uploaded on ChessInTaiwan. ChessInTaiwan is not responsible for any loss of content and related damages.

Advertisements and Promotions

The user agrees that any business dealings, interactions, or participation in sponsored giveaways or promotions with advertisers through ChessInTaiwan’s service, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between the user and such advertiser. The user agrees that ChessInTaiwan shall not be held responsible for any loss or damage incurred as the result of such interactions or dealings with advertisers.

Prohibited Behavior

The user shall not conduct any of the following while accessing or using ChessInTaiwan and services:
(a) Modify create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the ChessInTaiwan or services.
(b) Include commercial product placement in any published content on the ChessInTaiwan. ChessInTaiwan has the right to identify and remove the content in violation of the regulations.

Disclaimers of Warranty

ChessInTaiwan does not warrant that:
(a) the service will meet your specific requirements,
(b) the service will be uninterrupted, timely, secure, or error-free,
(c) the results that may be obtained from the use of the service and, ChessInTaiwan will be accurate or reliable,
(d) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and
(e) any errors in the service will be corrected. The user agrees that the use of ChessInTaiwan and the courses, is at the user’s sole risk. No advice or information, whether oral or written, obtained by you from us or through the service and ChessInTaiwan, shall create any warranty not expressly stated in these Terms.

Limitation of Liability

The user agrees that there are risks inherent into using our services. To the extent permitted by law, ChessInTaiwan is not liable for any indirect, incidental, punitive, or consequential damages(including loss of data, revenue, profits, or business opportunities, or other forms of loss), whether arising in contract, warranty, tort, product liability, or otherwise(even if we’ve been advised of the possibility of damages in advance), resulting from:
(a)the use or the inability to use the service and ChessInTaiwan;
(b)the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service;
(c)unauthorized access to or alteration of your transmissions or data;
(d)statements or conduct of any third party on the service;
(e)or any other matter relating to the service and, ChessInTaiwan, except as expressly provided in these Terms of Service.

General Clause

Where a dispute cannot be resolved amicably, the user and ChessInTaiwan agree to the exclusive jurisdiction of the Taiwan courts. The failure of ChessInTaiwan to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. If the provisions of these Terms of Service are invalid due to conflicts with the laws of Taiwan, the other provisions of these Terms of Service shall have full effect. The titles of these Terms of Service are for convenience only and do not have any legal or contractual effect.
